1. Introduction

Welcome to Pasuyo App (“Platform”, “we”, “our”, “us”), a pasabuy marketplace connecting individuals who wish to request items (“Requesters”) with individuals who want to earn extra income by using their extra baggage space and are willing to purchase and deliver items (“Travelers”).

By creating an account or using the Platform, you agree to these Terms & Conditions. If you do not agree, please do not use the Platform.

2. Nature of the Platform

• We are not a seller, retailer, courier, or logistics provider.
• We do not buy, sell, store, inspect, or deliver items.
• We do not verify the authenticity, safety, legality, or quality of any item.
• All transactions are conducted directly between users.

Users act independently and are not employees, agents, partners, or representatives of the Platform.

3. User Responsibilities

You agree that you will:

• Provide accurate and truthful information.
• Comply with all applicable local and international laws.
• Comply with all applicable import, export, customs, and tax regulations.
• Pay any applicable customs duties, taxes, or government fees associated with the item.
• Communicate respectfully with other users.
• Users may not use the Platform to send spam, unsolicited promotions, or any form of advertising not related to a legitimate transaction. This includes repeated, irrelevant, or disruptive messaging.
• Fulfill any commitments you agree to within the Platform.

Users are solely responsible for ensuring that requested or transported items comply with the regulations of the Bureau of Customs and other relevant authorities.

The Platform does not guarantee the performance, reliability, or legitimacy of any user.

You are solely responsible for the items you request, purchase, or deliver.

All interactions and transactions on the Platform are conducted at your own risk.

4. Prohibited Items and Customs Compliance

Users may not request, offer, or transport:

• Illegal drugs or controlled substances
• Weapons or explosives
• Counterfeit or infringing goods
• Hazardous or dangerous materials
• Stolen property
• Items restricted or prohibited by customs regulations
• Any item prohibited under applicable laws

Users are responsible for ensuring that items are legally allowed to be transported into or out of the Philippines and that all required declarations are properly made.

The Platform is not responsible for:

• Items confiscated or seized by customs authorities
• Delays caused by inspections or regulatory review
• Penalties, fines, duties, or taxes imposed by government agencies
• Additional costs arising from customs clearance

We reserve the right to remove content, cancel requests, or suspend accounts that violate this policy.

5. Payments

The Platform does not process, hold, guarantee, or secure payments between users unless explicitly stated. All payments and financial transactions are conducted at the sole risk of the users involved.

Users are responsible for:

• Verifying the identity and credibility of the other party
• Confirming item details before sending payment
• Ensuring payment methods are secure
• Conducting proper due diligence before completing any transaction

The Platform is not responsible for:

• Non-payment
• Fraud or scams
• Chargebacks
• Unauthorized transactions
• Financial losses arising from user transactions
• Disputes relating to pricing, payment timing, or payment methods

All payments and financial transactions are conducted at your own risk, and users are strongly encouraged to exercise caution and proper validation before transacting.

6. Disputes Between Users

The Platform is not responsible for:

• Lost items
• Damaged goods
• Delayed delivery
• Misrepresentation of items
• Failed transactions
• Any disagreement between users

Disputes must be resolved directly between users unless otherwise required by law.

All transactions and interactions are considered at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, the Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Use of or inability to use the Platform
• Transactions or interactions between users
• Any content posted by users
• Loss of money, property, data, reputation, or business opportunity

The Platform provides the service “as-is” and does not guarantee the performance, reliability, or legitimacy of any user or transaction.

8. Account Suspension and Termination

We may suspend, restrict, or terminate accounts that:

• Violate these Terms
• Engage in fraudulent, abusive, or harmful conduct
• Attempt to bypass safety or security measures

We reserve the right to take appropriate action at our discretion, including removing content that violates our policies or applicable laws without prior notice.

We also reserve the right to remove, restrict, or modify any content, including requests, messages, or listings, that violate these Terms or applicable laws.

9. User Safety and Blocking

Users may block other users to prevent further communication or interaction within the Platform.

Blocking a user may restrict access to messaging, visibility of content, or other interactions between the involved accounts.

This feature is provided to help users maintain a safe and comfortable experience while using the Platform.

10. Reporting and Moderation

Users may report accounts, content, or activity that they believe violates these Terms or applicable laws.

Reports may be submitted through the Platform’s reporting features or other designated channels.

We review reports at our discretion and may take appropriate action, including warnings, content removal, account suspension, or termination.

The Platform does not guarantee that all reported issues will be investigated or resolved, but we strive to maintain a safe and respectful environment.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the Republic of the Philippines, without regard to conflict of law principles.

13. User Content and Intellectual Property

Users retain ownership of the content they upload to the Platform, including but not limited to item photos, descriptions, and messages.

By uploading content, users grant the Platform a non-exclusive, worldwide, royalty-free license to store, display, process, and distribute such content for the purpose of operating and improving the Platform.

The Platform does not claim ownership over user-generated content.

14. Indemnification

Users agree to indemnify, defend, and hold harmless the Platform, its operators, and affiliates from and against any claims, damages, liabilities, losses, or expenses arising from:

• Violation of these Terms by the user
• Misuse of the Platform
• Transactions conducted between users
• Violation of applicable laws or regulations
• Content uploaded by the user

This obligation survives termination of the user’s account.
